Terms of Service
These terms govern your use of FreshLeads ("the Service"), operated by FreshLeads, a sole proprietorship of Ishaan Ratan Yadav, Gwarighat Road, Jabalpur, Madhya Pradesh 482002, India ("we", "us"), accessible at getfreshleads.io. By subscribing to or using the Service you agree to these terms. If you do not agree, do not use the Service.
1. What the Service provides
FreshLeads is a business-to-business sales-intelligence subscription. We identify direct-to-consumer brands showing commercial activity signals (funding, product launches, retail expansion, milestones), verify a business contact address for a decision-maker at that brand, and supply suggested outreach copy written from publicly reported information about that brand.
The Service supplies business contact information and research. It does not send email on your behalf, and it does not guarantee that any recipient will reply, engage, or become your customer.
2. Subscriptions, claims, and exclusivity
- Subscriptions are billed monthly in advance and renew automatically until cancelled.
- Each plan includes a stated number of lead claims per week. Claiming a lead unlocks its verified contact address and outreach copy, and that lead is yours to keep permanently.
- Unused weekly claims do not roll over to the following week unless we state otherwise in writing.
- Exclusivity: each lead may be claimed by a maximum of three (3) customers in total, after which it is retired and cannot be claimed again. Claim counts are shown before you claim. We honour this cap permanently for leads you have already claimed.
- We will not knowingly supply you a lead you have previously claimed.
3. Data accuracy and the replacement guarantee
Contact addresses are verified at the time we collect them, by SMTP check or by finding the address published by the brand itself. We never supply pattern-guessed addresses. However, business contacts change constantly and we cannot guarantee that an address remains valid indefinitely.
Replacement guarantee. If a claimed lead's contact address hard-bounces on first use, tell us within 30 days of claiming it and we will replace that lead free of charge, or restore the claim to your balance.
4. Your responsibilities and acceptable use
You are solely responsible for how you contact anyone whose details you obtain through the Service, and for complying with the laws that apply to you and to your recipients. Depending on where you and your recipients are located, these may include GDPR and the UK Data Protection Act, the US CAN-SPAM Act, CASL in Canada, and similar laws elsewhere. In particular you agree to:
- contact people only for genuine business-to-business purposes relevant to their role;
- identify yourself accurately and never use false or misleading sender details or subject lines;
- include a working opt-out in your messages and honour opt-out requests promptly;
- stop contacting anyone who asks you to stop.
You must not: resell, republish, sublicense, or redistribute the data; use it to build or enrich a competing database or list product; use it for consumer marketing, spam, fraud, harassment, or any unlawful purpose; or scrape, bulk-export, or circumvent claim limits and access controls in the Service.
Breach of this section may result in immediate suspension or termination without refund.
5. Licence
Leads you claim are licensed to you for your own outreach, permanently and non-exclusively (subject to the three-buyer cap in section 2). All Service software, interfaces, and compiled datasets remain our property. The outreach copy supplied with each lead is yours to use, edit, and send as you see fit.
6. Fees and changes
Prices are stated on our pricing page and are exclusive of any taxes that our payment provider is required to collect. We may change prices with at least 30 days' notice; changes apply from your next billing cycle. Existing founding-offer discounts are honoured for their stated duration.
7. Cancellation and termination
You may cancel at any time; see our Refund & Cancellation Policy. We may suspend or terminate access for breach of these terms, non-payment, or where required by law. On termination, leads you have already claimed remain yours.
8. Disclaimers and limitation of liability
The Service is provided "as is" and "as available". We do not warrant uninterrupted availability, or any specific reply rate, meeting, sale, or revenue outcome. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the three (3) months immediately before the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits or goodwill.
Nothing in these terms limits liability that cannot lawfully be limited.
9. Indemnity
You agree to indemnify us against claims, damages, and costs arising from your use of the data, your outreach activity, or your breach of these terms or of applicable law.
10. Changes to these terms
We may update these terms. Material changes will be notified by email or through the Service at least 14 days before taking effect. Continued use after that date constitutes acceptance.
11. Governing law
These terms are governed by the laws of India, and the courts of Jabalpur, Madhya Pradesh, India shall have exclusive jurisdiction, without prejudice to any mandatory consumer protections available to you locally.
